A female elementary teacher was fired the week after a picture of her and her female lover as she was participating in a highly controversial same-sex marriage demonstration was exhibited on the front page of the newspaper. The teacher filed a law suit against the district claiming her rights were violated. The district countered that such a public display of homosexuality would inhibit the teacher's effectiveness. How should the courts rule? What legal considerations should be examined?

Solution #1
In my opinion, the courts should rule in favor of the teacher. Her civil rights as an American were violate and that should be considered by the courts.

I totally agree. Had she made headlines for breaking the law in any way, I could see why she would be fired. Simply standing up for LGBT rights is not harmful in any way and could even teach students about the political process and how citizens can influence policies. It would encourage students to have a voice.

Solution #2
There is no possible reason that her effectiveness would be inhibited. Her affection is no different than that of a couple with different genders and therefore I would say that her rights have been violated and the court should rule in her favor.
